Website Terms of Use
1. About these terms
These Website Terms of Use apply when you access or use the website operated by UFB Global Standards Pty Ltd (ABN 76 680 228 835) (UFB Global Standards, we, us or our), submit an enquiry or request information through the website. By using the website, you agree to these terms. If you do not agree, please do not use the website.
These are website-use terms only. They are not the complete terms for a product sale, installation, wholesale account, distribution appointment, confidential disclosure or finance arrangement. Those matters will be governed by any separate quotation, order, sales or installation agreement, wholesale or distribution agreement, non-disclosure agreement, credit documents or other written terms that apply to the transaction.
Nothing in these terms excludes, restricts or modifies any right, guarantee, condition, warranty or remedy that cannot lawfully be excluded or limited, including under the Australian Consumer Law.
2. Website purpose and enquiries
The website provides general information about UFB Global Standards, UFB Dual™ technology, possible applications, business opportunities and related services. It is currently an information and enquiry website and does not provide online checkout or create a product purchase merely because a form is submitted.
An enquiry, brochure request, appointment request or request for a quotation is not an order, acceptance or guarantee of supply, installation, territory, exclusivity, pricing, availability, timing or suitability. A binding product, installation or commercial agreement arises only when the relevant parties accept a separate written quotation, order, agreement or other transaction document in the manner stated in that document.
3. Accuracy and product information
We take reasonable care when preparing website information, but website content is general and may be updated. Product specifications, dimensions, compatibility, availability, lead times, service areas, certification details and supporting evidence may change or depend on the proposed application. Obtain current written information and a project-specific quotation before making a purchasing, design, construction, installation or commercial decision.
Images, diagrams, animations and examples may be illustrative and may not show scale, every component or the final installed configuration. Do not use website images or dimensions as installation drawings. Any statements about ultrafine bubbles, water characteristics, biofilm or performance must be read with the stated test method, conditions, limitations and intended application; they are not an unconditional guarantee of a particular result at every property or project.
4. In-home assessments and water information
If you request an in-home assessment, the booking confirmation or separate assessment information will describe its scope. Unless we expressly confirm otherwise in writing, an assessment is an observational and information-gathering service. It is not a comprehensive plumbing inspection, laboratory water analysis, building inspection, environmental assessment, diagnosis or health assessment, and it does not certify that water is safe or suitable for a particular medical, industrial, agricultural or other specialised use.
Water conditions and system performance may vary with the source water, plumbing, flow, pressure, property conditions, installation and other factors. If you need health, drinking-water safety, engineering, building, regulatory or laboratory advice, obtain advice from the appropriate water authority, regulator, accredited laboratory or qualified professional.
You must provide safe and reasonable access to any area included in an agreed assessment and tell us or the attending representative about known hazards, access restrictions or relevant site conditions. We will seek appropriate permission before taking identifiable photographs or recordings inside a property. Any consumer sale discussed or agreed during or following an appointment is subject to the separate sales agreement and any cooling-off or termination rights that apply under law.
5. Brochures and confidential material
Public brochures, certificates and technical resources may be downloaded and used for genuine personal or internal business evaluation. They must not be altered, presented out of context or used to make misleading claims about UFB Global Standards or its products.
Some laboratory reports, biofilm evidence, technical material and commercial information are confidential and are not public downloads. A request for access does not guarantee access. We may require identity and business verification, approval and a fully signed non-disclosure agreement before providing controlled access. Confidential material remains subject to the applicable non-disclosure agreement and any use restrictions supplied with it.
6. Suitability, installation and maintenance
Product selection and installation depend on the property or project's plumbing, pipe size, water source, pressure, flow, intended use, site conditions and applicable laws and standards. The customer and the appropriately qualified designer, plumber or installer must verify suitability and installation requirements for the particular site.
Installation must be completed by appropriately licensed and qualified persons where required, and in accordance with current product instructions, applicable WaterMark conditions, plumbing requirements and local laws. Product information that refers to minimal maintenance does not mean that inspection, care or maintenance will never be required. Follow all current instructions, warranty conditions and professional advice supplied for the installation.
7. Business, wholesale and partner enquiries
The website invites enquiries from distributors, nano-bubble businesses, plumbing and filtration partners, suppliers, agriculture businesses, developers, builders and other professional users. Website content does not appoint a distributor, agent, representative or partner, grant exclusivity or a territory, authorise the use of our intellectual property, or create minimum supply, pricing or support commitments. Those matters require a separate written agreement signed or accepted by authorised parties.
No person may represent that they are employed by, authorised to bind, or exclusively appointed by UFB Global Standards unless this is confirmed in writing. Business partners must use current approved product information and must not make claims, promises or warranties beyond those authorised in writing.
8. Independent finance referrals
Independent finance options may be available through third-party finance providers. At your request, UFB Global Standards may introduce you to an independent finance provider operating under an Australian credit licence. UFB Global Standards is not the lender and does not assess eligibility or affordability, recommend or compare credit products, prepare a finance application, set interest rates, fees or repayment terms, make lending decisions or guarantee approval.
Any finance application and credit contract are between you and the relevant finance provider or lender and are governed by that party's credit guide, privacy policy, disclosures, terms and conditions. You should review those documents and obtain independent advice if needed. You are not required to use a provider introduced by us and may arrange finance independently.
UFB Global Standards may receive a referral fee or commission for an introduction or where finance proceeds following an introduction. Any benefit or commission will be disclosed at or before the referral as required. If you ask us to pass your details to the provider, we will first seek your specific consent and will limit the disclosure to your contact details and a short description of the finance purpose.
The product purchase and the finance arrangement are separate. Whether a purchase is conditional on finance, and what happens if finance is declined or delayed, will be determined only by the separate quotation or sales agreement.
9. Intellectual property
Unless stated otherwise, the website and its text, graphics, images, videos, diagrams, brochures, trade marks, logos and other content are owned by or licensed to UFB Global Standards and are protected by intellectual property laws. UFB Dual™ and associated branding must not be used in a way that suggests approval, affiliation, endorsement or appointment without written permission.
You may view, download and print public website material for genuine personal use or internal business evaluation. You must not reproduce, modify, distribute, sell, publish, scrape, frame, commercially exploit or create derivative materials from website content except with our prior written permission or as permitted by law.
10. Third-party websites and services
The website may link to or use services provided by third parties, including website, social-media, mapping, video, document, installer, distributor and finance services. A link or introduction does not make the third party our employee, agent or partner and does not amount to a guarantee or endorsement of every product, statement or act of that party. Third-party services are subject to their own terms and privacy practices.
11. Acceptable use
You must not:
-
use the website unlawfully, fraudulently or in a way that infringes another person's rights;
-
submit false, misleading, abusive, harmful or unauthorised information;
-
attempt to gain unauthorised access to the website, accounts, systems, data or confidential material;
-
introduce malware, interfere with website operation, probe security or place an unreasonable load on the website;
-
use automated tools to scrape, harvest or systematically extract content or personal information without permission; or
-
misrepresent your identity, authority, relationship with UFB Global Standards or entitlement to confidential information.
We may restrict access, reject submissions or take reasonable protective action if we believe the website or our rights are being misused.
12. Website availability and security
We may change, suspend or withdraw website content or functions for maintenance, security, legal, operational or business reasons. We do not guarantee that the website will always be available, uninterrupted, error-free or free from harmful code. You are responsible for using appropriate device security, backups and caution when downloading files or following links.
13. Privacy and cookies
Our collection, use and disclosure of personal information is described in our Privacy Policy. The website may use cookies and similar technologies as described in that policy and any cookie settings made available on the website.
14. Australian Consumer Law and liability
Our goods and services may come with rights and consumer guarantees that cannot be excluded under the Australian Consumer Law. These terms do not limit those rights or any liability that cannot lawfully be excluded or limited.
To the extent permitted by law, UFB Global Standards is not responsible for loss caused by using general website information as a substitute for current written product information, a site-specific assessment or advice from an appropriately qualified professional; by inaccurate information supplied by a user or third party; or by a third-party website or service outside our reasonable control.
15. Changes to these terms
We may update these Website Terms of Use to reflect changes to the website, our business practices or legal requirements. The current version and last-updated date will be published on the website. Changes apply to website use after publication and do not retrospectively change a separate agreement already formed unless that agreement permits the change or the parties agree.
16. Governing law
These Website Terms of Use are governed by the laws of Queensland, Australia. Subject to any law that provides otherwise, the parties submit to the courts of Queensland and courts entitled to hear appeals from them.
